Terms & Conditions 

These Terms & Conditions are available in our studio, on our website and social media outlets. A copy of the Terms and Conditions will also be provided to you at the point of purchasing an item with the company. It is your responsibility as a customer to read these conditions prior to purchasing an item from Ivy Rose Bridal Co.

1: Who is Ivy Rose Bridal Co and how to contact us

1: Ivy Rose Bridal Co is a studio that sells pre-owned, unworn and brand-new sample dresses to brides-to be. 

2: Ivy Rose Bridal Co is based in Room 1, First Floor, 28 Middle Street, Consett, Co Durham, DH8 5QJ. Within the terms and conditions this address will be referred to as ‘studio’. 

3: Ivy Rose Bridal Co has no association or affiliation with the brands whose items are offered for sale. All sales of designer gowns are done so by way of personal agreement between Ivy Rose Bridal Co and the original purchaser. 

4: We can be contacted in writing at the above address, by telephoning 07985 368318 or by emailing info@ivyroseweddings.co.uk

 5: Where referring to the words ‘writing’ or ‘written’ in the terms and conditions this also refers to emails, texts or social media messages between the company and a buyer. 

2: Our Contract

 1: On signing this contract and making the required payment by way of deposit or payment in full, a contact will come into existence between the company and buyer. 

2: If we are unable to fulfil your order, we will notify you within 48 hours of this being identified. This may be due to an item being out of stock, or no longer available due to us identifying an error with the item or pricing. Where this is identified we will not charge you for the item and any payment or part payment will be refunded in full to the buyer. 

3: All payments are non-refundable unless we cannot fulfil your order. Payments made are non-transferrable to another item or customer. 

3: Product Descriptions and Placing your order. 

1: All items within the studio are sold off the peg and therefore sold as seen. Ivy Rose Bridal Co strongly advise a full and thorough examination of the item prior to purchasing an item with us.

 2: All items purchased of the peg are sold as full and final sale. Items purchased from us are non-returnable and we do not offer refunds. Ivy Rose Bridal may offer to assist in reselling a dress purchased with us. 

3: When a dress is sold by Ivy Rose Bridal Co this will be removed from our studio rails until collected. Additional fees may apply for the storage and retention of items prior to collection. 

4: Products may vary slightly from their pictures, whether in brochures, on our website, social media or designer’s webpages or samples. We endeavour to display, advertise, and photograph items to show their colour and appearance however this may reflect differently on devices or printed materials. Ivy Rose Bridal Co emphasises that all dresses are made from a variety of fabrics meaning we are unable to guarantee the absence of minor imperfections. Where possible we will advise of these prior to the sale of an item. 

5: Ivy Rose Bridal Co shall not be held responsible for any claim arising from the disparity in shade, tone or positioning of different jewels or fabrics. 

6: Paying a deposit or making a payment in full for any item is a commitment by the seller to fulfil any outstanding amounts due. 

7: Ivy Rose Bridal Co accepts no responsibility for items not fitting following their purchase from us. 6: Ivy Rose Bridal Company propose to offer payment plans on all gowns priced £399 and over. Where a buyer opts to purchase a gown by payment plan a deposit of 50% is required at point of sale. Remaining balance can be paid in equal instalments over a maximum of 3 payments. All instalments are available interest free. 

8: Where instalments are missed Ivy Rose Bridal Co will endeavour to contact the buyer on 5 occasions to arrange payment. Where 5 unsuccessful attempts are made, Ivy Rose Bridal Co will retain the right to cancel the agreement and return the items to sale. 

9: Where an instalment plan is cancelled the buyer will be informed in writing within 5 days. Payments already received will be non-refundable to the buyer. 

9: Where an order is placed for accessories, this does not require a deposit and payment must be made in full at the time of sale. 

4: Your rights to end the contract.

 1: You may end this contract if the company breaks the terms and conditions at any point following the sale of an item. This can be done by writing to Ivy Rose Bridal Co notifying us of the breach and your request to terminate agreement. 

5: Our rights to end the contract. 

1: Ivy Rose Bridal Co has the right to end this contract if the customer breaks any of the terms and conditions within the contract. We may end to contract for an item if at any time you:

 i) You do not make payment for the item when it is due. 

ii) You do not, within a reasonable time, provide us with information required to provide you with the items. 

iii) You do not, within a reasonable time, allow us to deliver the products to you or collect them from us. 

6: Telling us about a problem with an item or making a complaint. 

1: If you have a question or complaint about an item, please contact us by the information provided in clause 1:2 and Clause 1:4. 

7: Pricing of items 

1: The pricing of an item will be displayed on all items within the studio and indicated on the purchase slip at point of sale.

 2: Where possible Ivy Rose Bridal Co will endeavour to ensure pricing is always correct. Should a discrepancy be identified prior to the sale the buyer will be informed of this. 

8: Storage of purchased items. 

1: Where items are purchased in full Ivy Rose Bridal Co offer an additional storage service for dresses. This is limited and available for the cost of £35. The maximum length of time to store the items is 3 months unless agreed with the company prior to seeking the service. 

2: Items that are purchased on a payment plan will be stored by Ivy Rose Bridal Co for the duration of the instalment plan period free of charge. Should additional storage time be required this will be subject to the additional cost of £35. 

3: Where a stored dress is not collected after the designated time Ivy Rose Bridal Co will attempt to contact the buyer to advise on collection. Where uncollected we reserve the right to charge a fee of £15 per week for additional time stored with us. 

4: Where a stored dress is not collected, and we have been unable to contact the buyer successfully Ivy Rose Bridal Co retain the right to retain control of the item.

 5: In the unlikely event that a buyers items are lost or damaged, due to fire, flood or theft whilst on our property, we shall only be responsible for reimbursing the studio retail price of the item. 

9: Alterations and Cleaning

 1: Ivy Rose Bridal Co do not currently provide this service. We can offer suggestions to third parties providing this service however do not accept responsibility for any services a third party provides. 

10: Liability 

1: Ivy Rose Bridal Co shall not be deemed to be in breach of this contract due to acts beyond our reasonable control. This is without limitation to act of God, war, riots, civil commotion or terrorist attacks, malicious damage, any national or international pandemic related occurrences, compliance with any law or government order, accident, fire, storm, or flood. 

2: Ivy Rose Bridal Co brings to your attention that the items purchased are particularly delicate and extreme care should be afforded to it. Consequently, Ivy Rose Bridal Co shall not be liable to damage caused to items arising from during or after the wedding, fair wear and tear, wilful damage, lost, accident or negligence to the buyer or any third party or failure to follow the instructions of Ivy Rose Bridal Co. 

3: We are not liable for business losses. We only supply products for personal and domestic use only. Where the items are purchased from us for commercial, business or resale purposes, we do not accept liability for any loss of profit, sales, loss of business, business interruption or loss of business opportunity. 

11: How we use your information 

Please refer to our privacy policy and how we will store and use information provided to us. 

 12: Other terms and agreements

1: Ivy Rose Bridal Co reserves the right to transfer our rights and obligations under these terms to another organisation. 

2: You may only transfer your rights and obligations under these terms to another person if we agree to do this in writing. 

3: This agreement is between Ivy Rose Bridal Co and the person who signs the contract. No other person shall have any rights to enforce any of its terms. 

4: Each paragraph of these terms operates separately. If any court or relevant authority decides that any of these are unlawful, the remaining paragraphs will remain in full force and effect. 

5: These terms are governed by English law, and you can bring legal proceedings in respect of the items in the English courts. 

6: Ivy Rose Bridal Co reserve the right to change or amend these terms and conditions at any time. You are recommended to regularly check the terms and conditions for any changes. These are available in writing or via social media and website. These terms and conditions are effective from 1st May 2024. 

7: By purchasing an item and signing your order you acknowledge acceptance of our terms and conditions and that you agree to purchase from Ivy Rose Bridal Co the items as specified.
